is there any possiblity that the EB3-ROW from Bngladesh become current soon. can you tell any approx.....days. What about in October....i heard that the new visa will be available in Oct every year. Is there any quota for different countries....??????? thanks again

I don't do studio stuff, so I can't advise on lighting, and you already have a lot of expert advice there already :)
My observations are; I think the glass itself looks great, but the red ornaments in #2 are distracting. Obviously a matter of taste since jpreston likes them. The background, keeping in mind that you improvised, has horizontal folds that I found distracting. A piece of black velvet or similar material would fix that, and isn't too expensive if you stick to one or two. I think the backgrounds become expensive when you buy a variety and have the means to move them around quickly to increase paying studio throughput. I think both images look good in general.

Hi everyone:
I'd appreciate if someone could give me an advice here. I am currently on the 6th year of H1B. It is expiring on Jan 31, 2008. Technically I will need a 7th year extension. My Labor Certification for Green Card (EB2, PD: Dec, 2002) was approved back in July, 07 and I filed I-140 and I-485 concurrently in the end of July. So far I have not received a receipt or anything back from them.
What shall I do in this situation -- can I apply for H1B extension now? Any advice will be appreciated.

USCIS is fishing form I485 application pool, in approvable cases, 2006 cases are nearest and an easy catch.

Saturn has plants to produce cars, BUT NO TECHNOLOGY OF THEIR OWN. NO R&D.
Saturn sells rebranded-rebadged OPEL (GM - EUROPE, now sold to Magna) Vehicles.
While Jaguar and Land Rover are very strong brands with their own technologies and research & design capabilities. Besides Tata bought those brands when Rupee was historically high (below 40 per USD). So I don't think Tata made any mistakes.
I think it is Mahindra who is making mistake by not buying Hummer or Volvo or Saturn. I am very excited to see first Indian Vehicle to be sold in US i.e. Mahindra in 2009. No matter what, I will be the first to buy one.

That is true, however, would that result in the 140 being cancelled? As per several discussions the 140 can still be used for extensions (assuming that the 140 has not been revoked/cancelled by USCIS due to fraud and that the PD is not current for that catagory). Again this is debatable and there are lots of opinions on this issue out there.
Some people say that the PD of the older 140 (even if revoked/cancelled by the former employer) can be used when the new company clears the labor and is applying for the new 140.
You need to consider two scenarios here...
First: Approved I-140 revoked by employer, since the employee is no longer with him and or employer no longer want to proceed with immigrant worker petition.
In this case the beneficiary of I-140 can recapture priority date to a future immigrant worker petition by his prospective employer ( at new I-140 stage)
Second: Approved I-140 revoked by USCIS due to Fraud
In this case the employer or employee can no-longer eligible to use that I-140 , which includes recapturing priority date.
Remember: To get H1B extension beyond 6th year one need to have valid approved and/or pending labor/I-140.
If the PERM labor expires then you can not use that to get 1 year extension

Usually we see IV members posting on this website if there is a pattern and trend. if there is one, some members take initiative and contact their law makers and talk to appropriate authorities.
Is there such a pattern? Members may post their experiences and hardships on IV.
DHS does takes measures to control fraud and abuse - but if it is affecting geniune people then genuine people can write about their issues here.

Why do you want labor substituion at this time when they are discontinuing for fraud? Are you working same company or joining the company for just labor substitution?
If you are waiting for long time for Gc then you can take risk. But if you are in US just for 1 or 2 years you have lot of time to get GC. If you are getting the labor in same company you are working now probably ok. But if you have too many uncertanities then it is better not to use it.

I thought that manager control rule is for L1 visa, where consultant must work only at direct client site.
It is part of new employer - employee relationship memo. One of my friends has been working for 3 yrs at US Company via 2 layers of vendors. He went for stamping at Delhi 2 months ago. During the interview he was told that his visa has been approved - however a week later his passport arrived with visa denied.

This lawsuit is about the 140000 visas been given out each year and in years 2008 and 2009.
There have been many people who received GCs in 2008 and 2009 in EB2 without regard to Priority number. Check Visa Bulletins from August 2008 and September 2008. People from 2006 were given GCs over 2004 and there was total chaos.
This lawsuit is to bring justice to the last three years of absolute anarchy.

I think Indian EB3 will join shortly.
Why are you stopping at 2007? Issues stared much before that.
Why do you forget the getting details of each and every VISA that was issued between 2003 and 2007 (days of backlog elimination center)? We hae a right to know that. I doubt EB based guys got benefit out of it....I do not think USCIS /DOS will ever reveal those numbers truthfully and even with 50% accuracy....
They just put almost every True Employment based applicant in backlog and gave GCs to 245i....I dont think that was justice. That was manipulation

This is how lots of people got approvals last year in july VB.

That explains it.If your company is blacklisted you are in a deep hole and should have a backup plan for employment. You should consult more good lawyers.

Just because you are here on an L-1A, that does not qualify you for EB1. The immigrant petition in question is likely the Multinational Manager (MM) I-140. If you were a manager abroad and are performing in a managerial role in the U.S., you may qualify for EB1. As you initially came over in L-1B status, it is more likely than not that you will not qualify for EB1.
If you were in a managerial role (either functional or personnel) abroad, it may be worth discussing this option with your attorney. Odds are that they already examined this possibility and determined that it was an unlikely to succeed.
