Even if I back date my marriage (as advised) , How can I get my future wife to USA?. I cannot get her on depend status as my H1-B (I believe) got canceled on approval of GC.
Issues I see,
1. The back date of marriage must match to my stay at India.
2. I did not visit India in the last one year.
3. I applied my I-485 in the August 2008 time. So (I must mention my marriage and dependents in the application). Which I did not . So this does not work.
See the troubles I have now.
P.S: I did not want to cheat USA Immigration Dept. Not a good practice

This is so depressing ...
Are they still talking about increasing H1Bs? That will create a bigger mess and those new H1Bs will have to wait 20 years before they can apply I485. Hopefully those who wish to come here as H1B will know the reality and won't be "trapped" as some of us have.

Are you talking about EB3-I? If not, ignore this post...
EB3-I dates are in Oct 01, there are no cases to approve, what will they approve?
What makes you think they are processing EB2-I more? Same logic applies here. Wait for the next bulletin, if you are EB3-I in 02 you'll get what is long overdue?
If thats the case then why don't they move the PD forward. EB3-I is stuck in 2001 since last 3 years and its not moving forward at all. How can we get some help here, ombudsman?

You are thinking only about the small percentage of "lost Indians" (including me) who are in this mess - if you really think about your motherland (and mine), help guys like NRN get a good infrastructure in place. By ridiculing him, what are you trying to say? had you been in his place, what would you have done? Settle here immediately, and launch a daily "freighter" to bring all Indians to US? I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.

sometimes people give irrelevant advice. one guy asks im getting divorced, what shud i do with respect to 485? if people tell him, stop worrying bout 485, focus on ur life and fix ur marraige, then its not helping him from a "forum" perspective.

Its a small good news. I got similar status update last year sometime in Aug/Sept before my I-485 was finally approved around end of Sept '08. My case was originally filed at CSC and then was transferred to NSC. I got this message when NSC finally picked up my transferred case, dusted it off an (I'm guessing) input it in their system. Most likely your cases went the similar route and now they have been finally picked up by the destination center for processing.
I hope that would be the case. But cannot expect much thinking realistically.

Everest Technology? Sounds so familiar, but definitely they are not in the list of blood suckers I dealt with.
There are thousands of bloodsuckers like this one, they know the Immigration law better than anybody else do, they will do anything to stop you from leaving their company.
BTW, you don�t need the copy of I-140 for using AC21 portability.
You might need a copy when you apply for a 3 years H1 extension, double check this with an attorney.
If I were you, I wouldn�t stick with this employer, I would definitely use AC21 after 180 days.

They've already said to give them until Aug 1st for June filers. Then they will focus on July filers. Simple as that. If your checks aren't cashed by Aug 1/2 for a June filer, then perhaps you have reason to call. If your checks are cashed, then YOU'RE IN, no need to call. Whatever you need is in the mail. If you don't get it by frst week of august, then call.

Your logic is beyond me. On one hand you seem to disagree with the practice of labor substitution but on the other hand you are more than happy to provide the recipe for it. Are you for it or against it. Or may be you are just trying to help an IV member.
It may be legal but should be discouraged to say the least.
I dont like that practise of labor substitution. Its unfair to everyone who cant do it, which is like 99.99 % of people. However, I am saying that its legal because it is. But by saying its legal, I am not saying that I am glad it happens.
If every one of labor petitions out there coming out of Dallas and Philly BECs are up for grabs then the priority dates will never move forward as newer employees keep getting ahead of those who are stuck.
The reason I am advising this guy is because I dont want him/her to get trapped at an employer where he is in a vulnerable position. I know this kind of employers very very well and they are inhumane (understatement). These are the guys who would make Jack Abramoff and Tom Delay look like ethical saints. You get the point. That is why I am saying that you need body armor when dealing with this kind of employer. That is why I would like this fellow to get his own immigration lawyer to handle everything so that HE/SHE has visibility and control, otherwise he/she is going to end up getting GC even after all of us have our GC after retrogression is over .

This is a pretty serious issue and needs to be looked at carefully - it could mean a significant difference to wait times for Indians and Chinese in EB2 category.

I saw the show yesterday. It is very sad that people like lou dobbs are twisting the facts by saying around 700,000 H1b visa holders are overstaying in USA. Also on that show one senator named "TOM" forgot his lastname, is saying the same and also that guy even did not know how long H1B is valid, he says it is valid for 5 years after that H1b visa holder become illegal. These kind of people spread hatered among common people against immigrants. is there way, we can sue these guys for their racist remarks/ misleadeing information?
i did watch the show, i feel my blood arousing to fight back. Well, we can try exposing his false faces to other TV show hosts like msnbc, foxnews etc.
Am sure there should be some law point to help us sue this guy.
