Can you please provide me with the information about the questions your friend faced? In my case the client side project was completed. I would appreciate your response.
I am not sure whether your case and my colleague's case is similar.
This happened in 2007. USCIS conducts random audits on companies to verify their authenticity.
USCIS conducted an audit on his company. They fixed an appointment with him in his office. They asked all the tax returns, W2, Paystubs etc. They also talked to his client manager and verified his duties.
After that everything went fine. He works for the same employer now.

Sorry to hear your story man. I can empathize with you coz I went through hell last July/2007. I tried to advance the wedding and it caused havoc in the family. I got married in End of Aug/07 and by then the dates retrogressed back.
Getting back to your situation:
1) F-1 is sure is an option. She will have to make sure that she is independent on her own application.
2) H-1 is an option as well, but then she will have to wait for next year lottery b.s.
3) Now that you have G.C. you can go back to India and work. There is some restriction as to how you can maintain your GC.
You may be found to have abandoned your permanent resident status if you:
* Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
* Fail to file income tax returns while living outside of the US for any period.
* Declare yourself a “nonimmigrant” on your tax returns.

in fact i think this memo is very favourable.
first of all it has some protections for h1b whistle-blowers.
second it formalizes the 27th, Dec, 2005 into the AFM which is much better.
this memo does not say that you cannot make an AC21 portability request based on a pending i-140/i-1485. all it says is that for the portability request to be valid the i-140 should be approved first. in fact it clearly alludes to the Yates memo and says that section 1 from that memo is valid and consistent with this interpretation. so, as far as my understanding goes you can still use AC21 even if your i-140 is pending.

I read about EB2 flow on one of the forums at immigrationportal.com. I'll try to find the thread and post the url if I can.
About EB2 people filing is only from my personal experience. Every single friend I knew who was in EB3 with PD somewhere mine filed for perm EB2.

At one point, there was concurrent filing. Just get LC approved and file for I-140 and I-485. Even if dates are not current. Then these filings were seperated. Then retrogression kicked in.
Now these GCs are getting aproved. So, don't worry.

Recently a friend of mine visited us in Houston and the purpose of his visit was that he surrendered his passports after getting his American Citizenship and waiting for the surrender certificate. He has been waiting for 2 months and still no luck. I am wondering why processing a surrender certificate takes such a long time?
I think that there is no proper process or people are not implementing it properly.
There is no point in fuming over these issues. These have to be resolved and I think that if there are enough people having issues and deal with it, we must do something about it.
As the first step, it would be a great idea to write a list of issues that we all face collectively. The issue must be genuine and real without looking at the emotional angle or with attitude. Do we want to do something to fix these issues?

To begin with let me say that I have earned my masters from the US but still I'm not in favor of this idea simply because getting a masters from the US does in no way prove that US needs us more than others (in light of EB law), or we are any smarter or more capable than people who did masters or even under grad from their home country..
Besides this will further divide the community which as is divided.
Just my 2 cents.
Is this still an active topic? or its dead? Are there people with US Master - STEM who are willing to come forward?
I am just trying to gauge this? To me, looks perfect candidate for piece meal while waiting for CIR, justification could be same as 20K quota for H1b, keep US educated in the country and keep contributing to US economy & society. It has two benefits, a) direct to people who have US Master, b) there will xx less number of people in front of who don't qualify for this so their turn will come sooner.

Well USCIS withdrew the Q&A they posted on their website for revision.
I hope they don't plan to screw the remaining name-check sufferers again.
They have been approving some of them in the past few days (and neither according to PD or RD, basically no FIFO, just based on officers whims)

Can you explain why EB2 ROW is flowing to EB3 and not to EB2 India?
Since May 2005
EB2 India has moved by 1 week.
so its ONE week in 9 months!
no matter what excuse they have, this is just pathetic.

You are thinking only about the small percentage of "lost Indians" (including me) who are in this mess - if you really think about your motherland (and mine), help guys like NRN get a good infrastructure in place. By ridiculing him, what are you trying to say? had you been in his place, what would you have done? Settle here immediately, and launch a daily "freighter" to bring all Indians to US?
