Hello All,
Thanks for your thoughts & advise. It helped me in my conversation with my company's attorney. I would first like to clear my educational background. I have 10 + 2( HSC/ 12th Grade) + 1 (1st year of Bachelors of Commerce) + 3 year Diploma in my field. That being said this is what she has advised/recommended.
She states that she is fairly confident that we can argue successfully the denial. She has said that she will file an MTR/Appeal & at the same time file a new I-140 too. She says she thinks there is a 50% chance that the MTR would be successful, if not she said it will go for appeal & take about a year. The advantage she said of filing a new I-140 at the same time is that she can make an airtight case with the cover letter covering the points for the reason for the denial of this I140 & the decision on the new I-140 would be fairly quick if the appeal is denied as it was filed witht eh appeal for the old one. The only disadvantage with a new I-140 would be that we cant file for 485 till there is an open visa, which means no EAD/AP for myself & my wife.
Can members with knowledge of these kind of scenarios shed some of their thoughts?
Thanks.
Hello All,
I have just received a copy of the denial notice that USCIS sent to the attorney for my I-140. This is what the notice states is the reason for the denial. Can someone please advise me what my chances are for an appeal to be approved? My lawyer is noncommittal at this this time. My I140 was filed under the EB3 Category. My 6th year of H1B expires in June.
"A Bachelor's degree is generallt found to require 4 years of education. Therefore, the beneficiary's 3 year diploma is not equivalent to a 4 year bachelors degree which is the minimum educational requirement to be classified as a professional on this labor certificate.
Under part H Number 4 of the Labor Certificate, the petitoner has checked the box "Other" under education. Under part 4-A the petitioner stated: 'Will accept academic studies evaluated as equivalent of US Bachelors'. The evaluation submitted indiactes that the beneficiary has the foreign equivalent of a US Bachelor of Science.
However this statement cannot infer that the petitioner will accept anything less than the minimum education requirements for a professional, i.e Bachelors degree. The evidence indicates that the beneficiary does not have a bachelors degree or foreign equivalent degree. Therefore, the beneficiary does not meet the minimum requirements of the ETA-9089"
Please note that I have a 3 year diploma & 1 year towards Bachelors in business & this case was files at the Texas Center. Any insights from knowledgeable members will be helpful.

Hello,
As we are aware that Immigrationvoice is going to send massive letters to Mr. President by saying broken immigration system.
Does anyone know that those letters already sent to white house or not? If yes, is there any reply from white house or not.
Please share it here.

Schumer Says Immigration Reform Will Happen - Roll Call (http://www.rollcall.com/news/36228-1.html)
Sen. Charles Schumer (D-N.Y.) maintained Wednesday that Congress will tackle comprehensive immigration reform this Congress, and perhaps even this year.
All of the fundamental building blocks are in place to pass comprehensive immigration reform this session and, even possibly, later this year, Schumer, the No. 3 Democratic leader, said during a speech before the Migration Policy Institute.
Schumer, chairman of the Judiciary Subcommittee on Immigration, Refugees and Border Security, outlined key principles that must be part a reform bill, including strong enforcement of illegal immigration, an employer-based verification system and a direct path to citizenship.
The Democratic Conference vice chairman, who will join a group of lawmakers at the White House on Thursday for a summit on immigration, underscored the intensity for solving this problem once and for all this year. Majority Leader Harry Reid (D-Nev.) has similarly suggested that immigration must be tackled sooner rather than later.
I have no doubt that President Obama has an unyielding commitment to achieving comprehensive immigration reform, Schumer said. And I truly believe that his leadership will be the critical difference in getting us over the hump this time around.
Schumer said the last legislative attempt in the 110th Congress failed because it wasnt strong enough in clamping down on illegal immigration. This year, he said, that issue must be a top priority.
I think on the part of the left, theres an understanding that unless we convince American were going to be really tough ... its the only way to do it, Schumer said.
With Republican losses among immigrant voters in the last election, Schumer said the GOP has an interest in moving on a reform bill as well.
Reid said Tuesday that immigration remains a top priority this year just behind health care reform and climate change legislation. He said he has spoken with White House officials on the matter, and despite a packed schedule that includes appropriations bills and a Supreme Court confirmation, the Majority Leader said he has the votes and the support to take on another complex issue this year. Obama, for his part, has said he wants to get negotiations rolling on immigration but hasnt laid out a timetable for passing a reform package.

Dear friends, why do you seek to start bashing your country at the first opportunity you get. THere are people in the Indian Govt who are negotiating on your behalf to make sur you get your money back.
THen on the question of paying bribes to get money out of PPF - something is better than nothing. Why complain. If it is so bad, go back and fight to fix the system, otherwise stop maoning. India is the only country that will welcome you if you are kicked out of here. I remember i used to pay 50 INR per ticket for a railway seat, now i go online and book a ticket. Things change they take time and patience.
Only those people who have NEVER bribed anyone to get stuff done illegally, or out of turn should speak. And i know there is no one, since you are in US and came on a passport and we all know how passports are obtained.
You left india, want to stay away, so leave it alone. When you are kicked out of everywhere, the doors will still be open, just keep some cash for the gatekeeper.
Lets discuss whether this swap will be possible or not, or what the loopholes are.
thanks
Never bribed to get my passport. Got it in Calcutta (now Kolkata), which has its negatives of course, but you don't have to bribe anyone to get a passport in Cal. The guy who came to do the police verification did not even ask for tea. But I agree with you. Most everyone in India has to pay bribes to get things done. And the corruption in India will not decrease by us complaining about it 3000 miles away. When India becomes more prosperous, there will be less visible corruption.

Nothing against IV. I really think, that they are doin a great job
But why do u have to care about whether IV endorses this or not. If you think this is a great idea, go ahead and send the flowers urself.
I know alot of my friends, who do not care or know about IV, but have got the email chain and sent flowers on their own
So Don't make excuses. Send it on you own
It'll be nice if the core endorsed it. We members do contribute and participate in all campaigns when core asks. It'll be great if the core lets the ideas bubble up from members too! That'll make it a two way street.

The best thing to ask for is a "time factor". If you have been in the US LEGALLY for a certain number of years (say 5 years), then you can apply for a Green Card (GC). That way people who have put some roots here over time will be able to become permanent residents. It also provides an incentive to immigrants to stay in status.
Why should there be a time factor from "GC" to "Citizenship" and none from visas like H1 to "GC"? It doesnt make sense! After all, I would think it should be harder to become a Citizen than to becoming a GC holder.
US should look up north to their Canadian neighbours for a good immigration system. A point system too would not be bad. It can determine how deep you have put down roots and then give you GC based on that.
Take for example, someone educated in the US, has been working on H1B for 4 years and with three kids that are American Citizens, and posses two properties in the US. It doesnt make any sense for that person not be able to becomoe a PR. Infact if he loses his job today, he's shown the door... that same day.

I think that people are talking about a combination of things that makes a contry attractive. Chicago is cold, but that's just one of the many live cities in the US. You have options here.
Take this scale of racism and good luck of it. .
I totally agree.
Guys thinking of moving to Canada - i have one advise. Try to work there for a short time - maybe 6 months and then see if you really want to immigrate to Canada. (Maybe as a consultant)
It is a beautiful country, no doubt. But opportunities, racial tolerance, good standard of living etc, all need to be considered while making such an important decision of one's life. Immigrating for reasons other than above is going to back-fire and a lot of lost-time and heart-breaks.
I have said this earlier and am saying it again - our home-country should rank much higher in our priorities than going to a country other than the US. I have been living in the US for a long time, worked in Canada for enough time to offer such advises.
Good luck!

Guys, This discussion has no relevance if the bills won't pass. So it is extremely important to call the specific House members. We are not trying to filibuster whatever you chose to dicuss. However, we are in crunch time and need all hands on the deck to gather support for the three bills. Please Please call the House members listed in this thread:

I think we need to have a thread to report the name of such companies...
That actually might be a good idea. These companies that mess with employees and take advantage of their visa status, should be taught such a torrid lesson that any other freakin desi consultants will think twice b4 messing with their employees. It's a sad thing that we Indians exploit other Indians in the name of "It's JUST Business".
